These terms are between you, the event organiser, and [Legal business name], [Address] (“TicketWorld.ca”, “we”). They apply when you set up or sell an event on TicketWorld.ca. Our Terms of use, Refund policy and Privacy policy apply to your buyers and are part of this agreement.
1. You are the seller
You sell the tickets to your event; we provide the platform. You are responsible for your event: that it happens as described, at the venue, date and time you list, and for the venue, permits, insurance, safety, accessibility, age limits, and following the law. You also set your own refund policy and handle refunds for your event (section 5).
2. Your organiser page and approval
- There is no password. Your organiser page is reached through a private link we email to you. Anyone with it can manage your events, so keep it secret. You can ask for it again on the For organisers page.
- You must confirm your email address, from the link we send, before you can publish events or connect your bank.
- Every new organiser needs our approval before their events are listed and go on sale. We may ask you for more information first. We can refuse or suspend an organiser at any time, for example over a complaint, a fake event, or a breach of these terms; a suspended organiser's events are taken off the site.
3. Honest events only
- No fake, misleading or duplicate events, and no events you don't have the right to sell tickets for.
- Your event details must be accurate: title, description, date, time, venue, age limits, and the venue's real capacity. You may not sell more tickets than the venue can safely hold.
- Your images and text must be yours to use, and nothing in them may be unlawful, hateful or sexually explicit.
- Ontario's Ticket Sales Act, 2017 applies to your sales. You must tell us, if asked, how many tickets you are offering for general sale and how many you hold back, so we can disclose it to buyers.
4. Prices, fees and payouts
You set the face value of each ticket tier. Buyers then pay, per ticket:
- your face value;
- our service fee of 8% of face value, at least $3;
- a facility fee of $2.50, which is yours;
- 13% HST on your face value and facility fee, only if you are registered for GST/HST;
- and 13% HST on our service fee, only if we are (we aren't at present).
Buyers see this all-in price from the start, as Ontario law requires. Payment works through Stripe Connect:
- You connect a Stripe Express account (on Stripe's own pages, where you give your bank and identity details) and agree to Stripe's Connected Account Agreement. Until it is ready, your events can be listed but tickets can't be bought.
- Each order is charged directly to your Stripe account. TicketWorld.ca keeps the service fee (and our HST on it, if any), which Stripe sends to us from each payment.
- The rest is yours: face value, facility fee and your HST on them, if any, less Stripe's card processing fee, which you pay. Stripe pays it out to your bank on its schedule (normally daily). You can see payouts in your Stripe dashboard.
5. Refunds, cancellations and chargebacks
- Cancelled events. If you cancel an event or a date, every buyer must get a full refund, fees and any HST included. Tell us straight away.
- Other refunds follow your policy, which must be fair and clearly stated to buyers (for example, in your event description). Refunds are of whole orders only.
- Refunds come off your Stripe balance. Because the charge was made on your account, the refunded amount is taken from it. On a full refund we return our service fee too. Stripe doesn't give back its processing fee on a refund, so that stays a cost to you.
- We may refund buyers in full ourselves when an event is cancelled, doesn't happen as described, or a sale was fraudulent. Those refunds also come off your Stripe balance.
- Chargebacks (card disputes) are made against your Stripe account. The disputed amount and Stripe's dispute fee come off your balance. Respond to disputes through Stripe; we will help with order and check-in records.
- If your Stripe balance can't cover a refund or chargeback, Stripe may debit your bank account, and you remain responsible for the amount.
6. HST and other taxes
Only a GST/HST registrant may charge HST. When you set up, and any time on your organiser page, you tell us whether you are registered for GST/HST, with your registration number (9 digits, RT and 4 digits, like 123456789RT0001), or not registered as a small supplier (under $30,000 of taxable sales over four calendar quarters). If you are registered, 13% HST is added to your face value and facility fee, your number is printed on buyers' receipts, and you are responsible for reporting and remitting that HST. If you aren't, no HST is added to them; you must register and tell us once you pass the small-supplier limit. Either way, any income tax on your sales is yours. We are responsible for the HST on our service fee, which we charge only while we are registered. Keep your answer up to date: what you tell us decides the HST on every ticket sold from then on.
7. Buyers' information
You will see some information about your buyers: their names at check-in, and their payment details in your Stripe account. Use it only to run your event and deal with their orders, keep it secure, and follow PIPEDA. Don't send buyers marketing emails unless they have given you consent under Canada's Anti-Spam Legislation (CASL).
8. At the door
Every ticket has a QR code that gets one person in, once. Use our check-in page to scan tickets at the door; refunded and cancelled tickets are turned away.
9. Our responsibility
We provide the platform as it is and work to keep it running, but we can't promise it will never be interrupted. As far as the law allows, our total liability to you is limited to the service fees we earned from your events in the 12 months before the claim. You agree to cover our losses from claims caused by your event or your breach of these terms.
10. Ending this agreement
You can stop selling at any time by unpublishing your events; tickets already sold must still be honoured or refunded. We can end this agreement or suspend you as in section 2. Sections 5, 6, 7 and 9 continue after it ends.
11. Changes and law
We may update these terms and will tell you by email before changes affect you. Ontario law applies, and disputes go to the courts of Ontario. Questions: [support email].
